Business Law—Corporate and Commercial

"Brenda A. Johnston, a proud member of Peguis First Nation, brings over two decades of expertise in Indigenous law and business law. Called to the Manitoba Bar in 1996, she has dedicated her career to providing comprehensive legal services to Indigenous individuals, First Nation bands, political organizations, and fishing and trapping groups.

Brenda has extensive experience creating tailored business structures for Indigenous clients, including Indigenous-owned corporations, joint ventures, and limited partnerships on and off Reserve lands. Her deep understanding of the unique lending issues related to Reserve land allows her to navigate complex legal matters under the Indian Act and the First Nations Fiscal Management Act. She is well-versed in addressing property and security provisions, including exemptions from seizure, garnishment, and attachment.

Brenda is also highly skilled in all aspects of Reserve creation and designation, including pre-reserve designations. She played a key role in negotiating and drafting the first municipal and development services agreement in Winnipeg between a First Nation and the City of Winnipeg. She has supported her community in Peguis First Nation with the negotiation and development of a municipal and development services agreement for the 1075 Portage Avenue Reserve lands in Winnipeg. She continues to assist other First Nations in Manitoba and Alberta with similar agreements, contributing to the economic development and self-sufficiency of Indigenous communities.

Her legal expertise also extends to the First Nations Land Management Act, where she regularly assists First Nations with developing and reviewing land codes, individual Transfer Agreements, and Community Ratification documents.

With a deep commitment to Indigenous rights and a wealth of experience in business law, Brenda is a trusted advocate for her clients, helping them navigate the complexities of governance, economic development, and land management."
