The Claim

Fisher River Cree Nation has initiated a class action lawsuit against Canada for failing to meet its obligations regarding annual Treaty annuity payments. These payments, central to First Nations' compensation under the treaties, have fallen far short while Canada and settler society gained enormous benefits, including land and resource access. Despite this, First Nations members continue to receive just $5 annually, plus $25 for each chief and $15 for each councillor.

Fisher River Cree Nation, alongside all Treaty 5 First Nations that opt-in, seeks declarations that Canada has violated and continues to violate Treaties 2 and 5, and are seeking liquidated damages.

The Class

All Treaty 5 Nations that opt-in, and all individuals (including estates, executors, or personal representatives) who are members of Treaty 5 Nations and entitled to annuity payments from Canada under Treaty 5.
