Treaty 2 Annuity Payments Class Action

Lake Manitoba First Nation has filed a class action against Canada, seeking compensation for annual Treaty annuity payments that have fallen embarrassingly short of Canada’s commitments under the treaty.

The Claim

Lake Manitoba First Nation has filed a class action against Canada, seeking compensation for annual Treaty annuity payments that have fallen embarrassingly short of Canada’s commitments under the treaty. These annuity payments were meant to be a key component of the compensation for First Nations, while settler society and Canada gained immense benefits, including access to land and natural resources. While these benefits have grown over time, First Nations continue to receive only $5 annually per individual, $25 per chief, and $15 per councillor.

Lake Manitoba First Nation, along with all Treaty 2 First Nations that join this class action, are seeking declarations that Canada has breached and continues to breach Treaties 2 and 5, and are pursuing liquidated damages.

The Class

All Treaty 2 Nations who opt-in to the class action and all persons (individuals), including their estates, executors, or personal representatives who are Indians of Treaty 2 Nations and are entitled to receive payments from Canada pursuant to Treaty 2.
