The Claim
This class action alleges that the Government of Canada and provincial governments discriminated against Indigenous children by removing them from their families and communities through child services programs and denying them essential services. These actions have caused irreparable harm to Indigenous children, their caregivers, and their communities by disrupting family bonds, cultural traditions, and essential supports. The lawsuit seeks justice and compensation for the cultural loss, trauma, and systemic racism inflicted by these discriminatory practices.
The Class
This lawsuit seeks compensation for:
- Indigenous children removed by child services since 1991.
- Indigenous children denied essential services since 1992 (or since 1975 in Nunavik).
- Family caregivers of these children who were impacted by these actions.
